The Pikaaso platform

Pikaaso’s role is that of an intermediary in the form of an online marketplace and is limited to managing the website to enable Sellers to exhibit, advertise, display, make available and offer to sell their products, and to enable Buyers to purchase the products so offered, along with other incidental services that facilitate the transactions between Buyers and Sellers. Accordingly, the contract for sale of any of the products shall be a bipartite contract between the Buyer and the Seller. Title in the products and all other rights and interests in the products shall pass directly from the Seller to the Buyer.

Pikaaso policies and rules are common guidelines that create a safe, trusted, and fair trading environment for all pikaaso.com members. To promote a safe and trusted trading environment, pikaaso.com enforces these policies and rules.

All members are responsible for reviewing and understanding Pikaaso policies and all applicable laws and regulations contained in this legal contract.

Becoming a seller is free

The products on Pikaaso Store are owned by the sellers, not by us. We provide a platform; we do not take ownership of the products. Becoming a seller and showcasing your products on the Pikaaso Store is free, but there is a review process before your products are published on the store.

Information we ask at registration

We ask for basic information while registering as a seller on our website — seller name, email, phone, and minimum products with prices. While submitting the form you must accept our terms & conditions.

Information or content we collect

After you have registered as our seller, you can upload and submit categorized products. If we like any products that you have displayed on your website, blog, YouTube, Facebook, etc., we will add them as products under your seller profile. We do not accept any copied content or products. If another seller or a legitimate rights-holder reports your content or products, we may remove them after verification.

Process to become a seller

There are a few easy steps to sign up as a seller. Below you’ll find information that will help you get started, including details about payment, submission requirements, and other important information about being a seller.

Seller terms (T & C)

We ask that as a seller you always abide by the following rules:

• The items you upload for sale must be your own creation. Do not submit works based on tutorials or other people’s designs.
• All items to be delivered to a customer will be delivered through Pikaaso Store after review.
• We are not responsible if any person or company reports a copied product that you upload.
• You must have the rights to license the products you upload — either because they are your own original content, or because you have a license that grants you permission to resell any third-party assets included with your item.
• If you believe that anyone on any of the Pikaaso sites has copied one of your products or is otherwise infringing upon your intellectual property rights, please report this behaviour to our Help team.
• Do not upload products that contain explicit profanity, nudity, or extreme violence.
• Everything uploaded to Pikaaso Store should be appropriate for commercial sale.
• You, as a seller, agree to deliver by the delivery timeline given on the product page of your product.
• The total product cost put up on the store will be Item Cost (given by seller) plus 25% of the item cost (seller fee).
• 25% of the item cost (the seller fee) is payable to Pikaaso Store as charges for showcasing your products on our store.

E-cards specific delivery terms

Every item that you render and deliver to Pikaaso Store will be appended with the Pikaaso logo (dimensions 150×50 px) before delivering it to the end customer. The customer is given 2 revisions for every product they buy on the store.

Fees and services

Membership on the website is free. pikaaso.com does not charge any fee for adding products on the website. However, we stand for quality and customer support, and therefore only the best sellers make it to sell on our website. Before you apply as a seller, we request you to review our Fees and Credit Policy below. pikaaso.com reserves the right to change its Service Fee and Credit policies from time to time at its sole discretion, including without limitation the right to introduce fees for new services offered or to amend/introduce fees for existing services. Any modifications to the Fee and Credit policies shall be posted on the website and such changes shall become effective immediately. Unless otherwise stated, all fees shall be quoted in USD. Taxes: you are responsible for paying all fees, and you agree to bear all and any applicable taxes, charges, cesses, etc. levied thereon.

Payment terms

We will pay you the item price component of the total price, less the seller fee. To do this, you authorize us to collect payments and credit your Pikaaso Store account with your earnings. Your earnings from the sale of your products will be payable to you on a weekly or fortnightly basis, to your PayPal or net banking account. Thresholds: we’ll make payments of your earnings based on certain minimum threshold amounts.

pikaaso.com uses third-party payment providers to receive payments from Buyers on the Seller’s behalf. pikaaso.com is not responsible for delays, erroneous transaction execution, or cancellation of orders due to payment issues. pikaaso.com takes utmost care to work with third-party payment providers but does not control their systems, processes, technology or workflows, and hence cannot be held responsible for any fault at the end of payment providers. pikaaso.com does not release payment to Sellers until the order has been received by the Buyer and they are satisfied with it. pikaaso.com shall only make payments to Sellers subject to realization of payment received from the Buyer. The Seller payment is typically net of the service fee charged by pikaaso.com for its services and after deduction of applicable withholding taxes (if any).

When a refund needs to be given

These refund rules provide a transparent approach, giving both you and your buyers a great platform experience and a “fair go”.

As the creator and owner of your products, you as an author are responsible to the people who buy them. These rules are based on consumer laws that we believe are the best baseline to apply to transactions that happen on Pikaaso Store. Please be aware that, in addition to these rules, each country has its own laws surrounding refunds, and we recommend you familiarize yourself with any applicable laws where you are located and where a buyer is located.

Here are the situations in which we expect you to give a refund on your item and related services if requested by the buyer:

Product is “not as described”
An item is “not as described” if it is materially different from the item description or preview, so be sure to “tell it like it is” when it comes to the features and functionality of your products. If it turns out the item is “not as described” you are obligated to refund buyers of that item.

Product doesn’t work the way it should
If an item doesn’t work the way it should and can’t easily be fixed, you are obligated to refund buyers of the item. This includes situations where your item has a problem that would have stopped a buyer from purchasing it had they known. If the item can be fixed, you should do so promptly by updating your item; otherwise you are obligated to refund.

Product has a security vulnerability
If an item contains a security vulnerability and can’t easily be fixed, you are obligated to refund buyers of the item. If the item can be fixed, you should do so promptly. If your item contains a security vulnerability that is not patched in an appropriate timeframe, you are obligated to refund.

When a refund does not need to be given

If your item is materially similar to the description and preview and works the way it should, there is generally no obligation to provide a refund in situations like the following:

• They don’t want it after the video has been delivered.
• The item did not meet their expectations.
• They simply changed their mind.
• They bought an item by mistake.
• They ask for goodwill.

Resolving disputes

If you and your buyer can’t come to an agreement about a refund, Pikaaso will investigate the matter and try to resolve the issue. We will make a decision based on all available information, and if we decide to issue a refund we will process it on your behalf (the cost of which may be shared with you).

Even though you must still follow these rules as a baseline standard, if a buyer requests a refund, you as the creator and owner of the item can decide to grant a refund independent of these rules.

Selling and advertising

As a registered member, you may list items for sale or advertising on the website in accordance with the Listing Policies detailed more fully in the Pikaaso Rules and Policies section, which is incorporated by way of reference into this Agreement. You represent that you are legally allowed to sell or advertise the items you list. You further agree to ensure that the products you sell or advertise through Pikaaso are genuine and are not counterfeit or stolen items. You further agree that the items or products you list do not infringe upon the intellectual property, trade-secret, or other proprietary rights, or rights of publicity or privacy, of any third parties.

You acknowledge and understand that “Listings” may include text descriptions, graphics, and pictures that describe your item for sale. You shall be deemed to be infringing the intellectual property rights of a third party if you are: (i) affixing a registered trademark (or an identical or similar trademark likely to confuse the public to have an association with the registered trademark) of such third party to your goods or its packaging; (ii) offering or putting for sale or stocking the goods under the said trademark; or (iii) using the said trademark in advertising your product.

You acknowledge that if any genuine claim is received by Pikaaso from any person through the Report Abuse section of Pikaaso (terms of which are incorporated herein by reference), Pikaaso may in its sole discretion block your merchant/user account and/or remove the products listed by you on Pikaaso, without any prior notice to you. Pikaaso will however provide you a post-facto intimation regarding the same. You agree that you shall have no claim whatsoever against Pikaaso in this regard, and the decision of Pikaaso as aforesaid shall be binding on you.

You further agree to ensure that the listing description of the item must not be misleading and must describe the actual condition of the product. All listed items must be listed in an appropriate category on the website. All listed items must be kept in stock for successful fulfillment of sales. If the item description does not match the actual condition of the item, you agree to replace the product delivered to the Buyer with the correct product and/or refund any amounts received from the Buyer within 10 days of receipt of intimation from us. You agree not to list a single product in multiple quantities across various categories on the website. Pikaaso reserves the right to delete such multiple listings.

Please note that the terms are subject to change by the firm in its sole discretion at any time.
